Terms of Service

1. Acceptance of Terms

By ordering, accessing, or using StackByte services, you agree to these Terms of Service and all applicable laws and regulations. If you do not agree with these terms, you must not use our services.

StackByte may update these terms from time to time. Any changes will be published on our website, and continued use of our services after changes are published means you accept the updated terms.

2. Description of Services

StackByte provides VPS hosting, server infrastructure, and related hosting services for individuals and businesses.

  • Virtual server resources such as CPU, RAM, storage, and bandwidth
  • Network connectivity and infrastructure hosting
  • Technical support and customer assistance
  • DDoS protection and security-related services where included
  • Backup or recovery options where specifically offered

We may modify, suspend, replace, or discontinue parts of our services where necessary for security, maintenance, abuse prevention, or business reasons.

3. Account and Registration

Some services require a customer account. You must provide accurate, complete, and current information when registering or ordering services.

Account Security

You are responsible for protecting your login details and for all activity performed through your account. You must contact StackByte immediately if you suspect unauthorized access.

Customer Responsibility

StackByte is not responsible for losses caused by weak passwords, shared credentials, compromised devices, or failure to secure your account.

4. Payments and Billing

Services are billed in advance according to the selected billing cycle. Invoices must be paid before the renewal date to avoid interruption.

Prices

Prices are shown on our website and may change. Existing customers will be notified of relevant price changes before they apply to active recurring services.

Refunds

StackByte may offer a 14-day refund period for new customers if the service has not been used. A service is considered used once a server has been deployed, an operating system installed, files uploaded, traffic generated, or similar usage has occurred.

Late Payment

If payment is overdue, the service may be suspended. If payment is not received within 7 days after suspension, the service and related data may be permanently deleted.

5. Acceptable Use

You agree to use StackByte services legally, responsibly, and without harming our platform, network, customers, or third parties.

  • No violation of applicable laws or regulations
  • No copyright, trademark, or intellectual property infringement
  • No malware, botnets, phishing, scams, or harmful code
  • No spam or unsolicited bulk messaging
  • No attacks, abuse, or disruption of networks or systems
  • No collection of personal data without proper consent
  • No unauthorized scanning, scraping, or automated exploitation

6. Prohibited Activities

The following activities may result in immediate suspension or termination without refund:

Illegal Use

  • Hosting or distributing illegal material
  • Fraud, phishing, impersonation, or scam activity
  • Distribution of pirated or stolen content
  • Financial fraud or abuse

Security Abuse

  • Unauthorized access attempts
  • Port scanning or vulnerability testing without permission
  • Distribution of viruses, malware, or exploit kits

Resource Abuse

  • Cryptocurrency mining without prior written approval
  • Proxy, VPN, or torrent services without permission
  • Excessive resource usage affecting other customers

7. Customer Conduct and Public Statements

Customers must not knowingly publish false, defamatory, or intentionally damaging statements about StackByte, our services, employees, or partners.

Genuine reviews, criticism, and support complaints are allowed, but deliberately false claims, harassment, threats, or attempts to damage our reputation through misinformation may be treated as a serious breach of these terms.

8. Windows Licenses

StackByte does not provide Windows licenses unless explicitly stated on the product page. If you install Windows on your VPS, you are responsible for obtaining and maintaining a valid license.

We may request proof of licensing where required. Failure to provide proof may result in suspension of the affected service.

9. Disclaimer and Limitation of Liability

StackByte services are provided “as is” and “as available”. We do not guarantee uninterrupted operation, error-free service, or permanent availability.

StackByte is not liable for data loss, downtime, lost revenue, indirect damages, or consequential losses.

To the maximum extent permitted by law, StackByte’s total liability is limited to the amount paid by the customer for the affected service during the three months before the incident.

10. Suspension and Termination

We may suspend a service without prior notice if we detect abuse, security risks, unpaid invoices, legal issues, or violations of these terms.

We may terminate a customer relationship with 30 days’ notice. Serious violations may result in immediate termination without refund. After termination, data may be permanently deleted.

11. Governing Law and Disputes

These terms are governed by Danish law. Any disputes shall be handled by Danish courts unless mandatory law states otherwise.

Before legal action, both parties should attempt to resolve disputes through reasonable dialogue.

12. Lifetime VPS

Lifetime VPS products are special one-time-payment services. “Lifetime” means the service may remain active as long as the product is offered by StackByte and the customer keeps it active according to these terms.

Activity Requirement

A Lifetime VPS must show activity at least once every 30 days. Activity may include:

  • Network traffic to or from the VPS
  • Login to the customer area
  • Login to the control panel
  • Connection to the VPS through SSH, RDP, or similar access

Inactivity

If no activity is detected for 30 days, StackByte may suspend the Lifetime VPS. If the customer does not respond within 7 days after suspension, the VPS may be permanently deleted without refund.

Company Closure

If StackByte closes, discontinues the product, or stops offering hosting services, Lifetime VPS products may be cancelled without refund.
